Terms of Service

Plain English. Short. Fair. Here's the deal between you and Toui.

1. Agreement

By using Toui ("the Service"), you agree to these Terms. If you don't agree, don't use the Service. You must be at least 13 years old (or the age of digital consent in your country, whichever is higher) to create an account.

2. Your account

• You're responsible for keeping your login credentials secure.
• You're responsible for all activity that happens under your account.
• One person per account — don't share accounts.
• Tell us immediately if you think someone's accessed your account without permission.

3. What you can use Toui for

Toui is a personal meal planning tool. You can:

• Generate recipes for personal and household use
• Plan meals, build shopping lists, and track your pantry
• Save and share recipes with friends and family

4. What you cannot use Toui for

• Reselling Toui-generated recipes or content commercially without our permission
• Reverse-engineering, scraping, or systematically extracting content from the Service
• Using Toui to harm, harass, or defraud anyone
• Uploading content that's illegal, threatening, or infringes others' rights
• Attempting to overload, disrupt, or bypass rate limits on the Service
• Using bots, scripts, or automated systems to access the Service
• Abusing the credit system (creating multiple accounts to exploit free tiers, reselling credits, etc.)

5. Subscriptions and billing

Free trial and paid plans

Toui offers a free trial with a limited number of recipes. Paid plans (Bronze, Silver, Gold) unlock additional recipes and premium features. Pricing is listed on the pricing page and in the app.

Automatic renewal

Paid subscriptions renew automatically at the end of each billing cycle. You can cancel anytime from your Account settings. If you cancel, you keep access through the end of the current billing period.

Refunds

Subscription fees are generally non-refundable, except where required by law. If you believe you've been charged in error, email billing@toui.app and we'll review it.

Price changes

We may change our prices. If we do, we'll notify you at least 30 days before the change takes effect. The new price only applies to billing cycles after that notice.

6. AI-generated content

Toui uses artificial intelligence to generate recipes, cooking instructions, and related content. Because this content is AI-generated:

• We don't guarantee nutritional accuracy. Nutrition estimates are approximate.
• Always use common sense. If a recipe calls for something that sounds unsafe (like an unsafe internal temperature for meat), trust your judgment over the app.
• Allergies and dietary restrictions: While Toui tries to respect your stated restrictions, you are ultimately responsible for verifying ingredients before cooking, especially for serious allergies.
• Food safety: Follow basic food safety practices (wash hands, cook meat to safe temperatures, refrigerate leftovers).
• No medical advice. Toui does not provide medical, nutritional, or dietary advice. Consult a qualified professional for those.

7. Your content

You keep ownership of content you upload (pantry lists, preferences, feedback, photos). By uploading, you grant us a limited license to use that content solely to operate and improve Toui.

8. Our content

The Toui app, brand, design, and software are our intellectual property. Recipes generated for your personal use are yours to cook, save, and share with friends. Don't republish, resell, or commercially exploit them without permission.

9. Service availability

We aim for high uptime, but we don't promise the Service will always be available. We may take the Service offline for maintenance, updates, or other reasons. We're not liable for losses caused by Service unavailability.

10. Termination

You can delete your account anytime from your Account settings. We can suspend or terminate your account if you violate these Terms, abuse the Service, or for any other reason with reasonable notice. If we terminate without cause, we'll refund any unused prepaid subscription fees.

11. Disclaimer of warranties

Toui is provided "as is" and "as available." We don't warrant that the Service will be error-free, uninterrupted, or that the recipes will meet your specific needs. Cook at your own risk. Use the app at your own risk.

12. Limitation of liability

To the maximum extent permitted by law, Toui and its owners, operators, and affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

13. Indemnification

You agree to defend and hold us harmless from claims arising out of your misuse of the Service or violation of these Terms.

14. Governing law

These Terms are governed by the laws of the state of Delaware, USA, without regard to conflict of law rules. Disputes will be resolved in the courts of Delaware, or — at our option — through binding arbitration under the rules of the American Arbitration Association.

15. Changes to these Terms

We may update these Terms. If we make material changes, we'll notify you by email or in-app at least 14 days before they take effect. Your continued use of Toui after changes take effect means you accept the new Terms.

16. The whole deal

These Terms and our Privacy Policy make up the full agreement between you and Toui. If any part of these Terms is found unenforceable, the rest stays in effect.
